Terms of Use
1. Acceptance
By installing, opening, or using CROAKDOWN ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app.
2. The app
CROAKDOWN is a single-player puzzle game published by Red Frog Black ("we", "us"). It is provided "as is" for personal, non-commercial entertainment.
3. Eligibility
You must be at least 13 years old (or the digital age of consent in your country) to make an in-app purchase. Users under that age may play the free portion of the game with parental permission and must use parental controls to prevent unauthorised purchases.
4. In-app purchases and subscriptions
- CROAKDOWN offers consumable items (gems, bundles), non-consumable items (skin packs, lifetime Pond Pass), and auto-renewing subscriptions (Pond Pass Monthly, Pond Pass Annual).
- Subscriptions renew automatically at the end of each period at the listed price unless cancelled at least 24 hours before the end of the current period.
- Cancellation is managed through your Apple ID Subscriptions or Google Play Subscriptions screen, not within the app.
- All purchases are processed by Apple or Google. We do not see, store, or transmit your payment details.
- Free trials, where offered, convert to paid subscriptions unless cancelled before the end of the trial.
5. Refunds
All purchases are final. Refunds, where they apply, are governed by Apple's App Store Terms or Google Play's Terms. Contact Apple or Google directly to request a refund. We will reasonably cooperate with legitimate refund requests.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to derive the source of the app beyond what is permitted by your local law
- Use the app to violate any law
- Attempt to bypass purchase verification, grant yourself entitlements, or otherwise cheat purchase systems
- Resell, sublicense, or commercially redistribute the app
7. Intellectual property
All artwork, code, audio, level designs, and text in CROAKDOWN are owned by Red Frog Black or licensed for use. You receive a personal, non-exclusive, revocable, non-transferable licence to use the app for personal entertainment. You receive no ownership rights.
8. Account and data
CROAKDOWN does not require an account. Game data is stored locally on your device. You may export or delete it at any time via in-app Settings. See our Privacy Policy for details.
9. Service availability
We do not guarantee continuous, error-free, or uninterrupted operation. We may discontinue the app, particular features, or particular SKUs with reasonable notice. If a feature you paid for is removed, we will offer a fair remedy (refund, credit, or equivalent feature) where required by law.
10. Disclaimer of warranties
To the maximum extent permitted by law, the app is provided "as is" without warranty of any kind, express or implied.
11. Limitation of liability
To the maximum extent permitted by law, Red Frog Black's total liability arising out of or relating to these Terms or the app is limited to the amount you have paid us through in-app purchases in the twelve months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages.
Nothing in these Terms limits liability that cannot be limited under your local consumer protection law.
12. Changes
We may change these Terms. Material changes will be notified in-app on next launch. Continued use after the effective date of the changed Terms constitutes acceptance.
13. Termination
We may suspend or terminate your access to the app if you breach these Terms. You may stop using the app at any time. Sections 5, 7, 10, 11, and 14 survive termination.
14. Governing law
These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, unless your local consumer protection law gives you the right to bring proceedings in your home jurisdiction.
